MASTER ENROLLMENT AGREEMENT
FocuStudio, LLC – Academy of Photography
Effective Date: January 1st, 2026
This Master Enrollment Agreement (“Agreement”) is entered into between FocuStudio, LLC (“FocuStudio,” “Academy,” “we,” or “us”) and the individual registering for courses (“Student”).
By creating an account and enrolling in any course, workshop, or activity, the Student agrees to the following terms:
1. Enrollment & Participation
Enrollment grants access to educational programs offered by FocuStudio. Participation in activities may include in-person classes, studio sessions, outdoor practices, workshops, and virtual instruction.
2. Media Consent and Image Release
The Student grants FocuStudio an irrevocable, perpetual, worldwide, royalty-free license to photograph, record, reproduce, edit, publish, and distribute the Student’s image, voice, and likeness for academic, promotional, advertising, editorial, and institutional purposes in any media now known or later developed.
This includes virtual sessions conducted via online platforms.
The Student waives any right to inspect or approve final materials and waives any claims related to right of publicity or privacy.
No compensation shall be provided.
3. Student-Created Content License
The Student grants FocuStudio a non-exclusive, worldwide, royalty-free license to use photographs, videos, and other content created during Academy activities for promotional and educational purposes.
Copyright ownership remains with the Student, except for the limited license granted herein.
4. Assumption of Risk & Liability Waiver
The Student acknowledges that participation in photography-related activities involves inherent risks, including but not limited to physical injury, illness, property damage, or death.
The Student voluntarily assumes all risks and releases FocuStudio, its directors, officers, instructors, employees, volunteers, and representatives from any claims arising from participation, including travel to and from Academy activities.
FocuStudio does not provide transportation.
5. Equipment & Facility Responsibility
The Student agrees to use equipment and facilities responsibly and in accordance with safety instructions.
The Student assumes financial responsibility for damages caused by negligence, recklessness, or intentional misconduct.
6. Health & Communicable Diseases
The Student acknowledges the risk of exposure to communicable diseases in in-person activities.
The Student agrees not to attend activities while experiencing contagious symptoms and voluntarily assumes associated health risks.
7. Governing Law
This Agreement shall be governed by and construed under the laws of the State of Florida, United States.
8. Mandatory Binding Arbitration
Any dispute arising out of or relating to this Agreement shall be resolved exclusively through binding arbitration in Florida under the rules of the American Arbitration Association (AAA).
The Student waives the right to litigation in court and to a jury trial.
9. Class Action Waiver
The Student agrees that any dispute shall be conducted solely on an individual basis and not as part of a class, consolidated, or representative action.
The Student expressly waives the right to participate in any class action lawsuit against FocuStudio.
10. Force Majeure
FocuStudio shall not be liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, governmental actions, pandemics, acts of God, labor disputes, or technological failures.
11. Severability
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
12. Entire Agreement
This Agreement constitutes the entire agreement between the Student and FocuStudio and supersedes all prior understandings or agreements.
13. Digital Acceptance
By creating an account and enrolling in any FocuStudio program, the Student acknowledges having read, understood, and agreed to this Agreement, which constitutes a legally binding contract.
ACUERDO MAESTRO DE INSCRIPCIÓN

Este Acuerdo Maestro de Inscripción (“Acuerdo”) se celebra entre FocuStudio, LLC (“FocuStudio” o “la Academia”) y la persona que se registra como estudiante (“Estudiante”).
Al crear una cuenta e inscribirse en cualquier curso, taller o actividad, el Estudiante acepta lo siguiente:
1. Inscripción y Participación
La inscripción otorga acceso a programas educativos ofrecidos por FocuStudio, incluyendo clases presenciales, sesiones en estudio, prácticas exteriores, talleres y clases virtuales.
2. Consentimiento de Imagen y Cesión de Derechos
El Estudiante otorga a FocuStudio una licencia irrevocable, perpetua, mundial y libre de regalías para fotografiar, grabar, reproducir, editar, publicar y distribuir su imagen, voz y participación con fines académicos, promocionales, publicitarios o institucionales.
Renuncia a cualquier derecho de revisión y a reclamaciones relacionadas con privacidad o derecho de imagen.
No recibirá compensación alguna.
3. Licencia sobre Contenido del Estudiante
El Estudiante concede a FocuStudio una licencia no exclusiva, mundial y libre de regalías para utilizar fotografías, videos u otros materiales creados durante actividades académicas con fines promocionales o educativos.
La titularidad de derechos de autor permanece con el Estudiante, salvo la licencia aquí otorgada.
4. Asunción de Riesgo y Exoneración
El Estudiante reconoce que las actividades académicas implican riesgos inherentes.
Asume voluntariamente dichos riesgos y libera a FocuStudio, sus directores, profesores, empleados y representantes de cualquier reclamación derivada de su participación, incluyendo traslados.
FocuStudio no provee transporte.
5. Uso de Equipos e Instalaciones
El Estudiante se compromete a utilizar responsablemente los equipos e instalaciones y será responsable por daños derivados de negligencia o conducta indebida.
6. Salud y Enfermedades Transmisibles
El Estudiante reconoce el riesgo de exposición a enfermedades transmisibles y acepta no asistir si presenta síntomas contagiosos, asumiendo los riesgos asociados.
7. Legislación Aplicable
Este Acuerdo se regirá por las leyes del Estado de Florida, Estados Unidos.
8. Arbitraje Vinculante Obligatorio
Toda controversia será resuelta exclusivamente mediante arbitraje vinculante en el Estado de Florida bajo las normas de la American Arbitration Association.
El Estudiante renuncia al derecho a juicio por jurado o litigio en tribunales ordinarios.
9. Renuncia a Demanda Colectiva
El Estudiante acepta que cualquier disputa será tratada de manera individual y renuncia expresamente a participar en demandas colectivas contra FocuStudio.
10. Fuerza Mayor
FocuStudio no será responsable por incumplimientos derivados de eventos fuera de su control razonable, incluyendo desastres naturales, pandemias, actos gubernamentales o fallas tecnológicas.
11. Divisibilidad
Si alguna disposición resulta inválida, las demás continuarán vigentes.
12. Acuerdo Completo
Este documento constituye el acuerdo completo entre las partes y reemplaza cualquier acuerdo previo.
13. Aceptación Digital
La creación de cuenta e inscripción constituye aceptación expresa y vinculante de este Acuerdo.
